Terms of Service

1. Agreement
These Terms of Service ("Terms") govern access to and use of Tanumo's website, studio, APIs, and related services (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
Tanumo provides tools to create and manage AI-generated design assets, brand workspaces, and related content. Features, credit limits, and availability may change.
We may modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.
3. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service.
We may suspend or terminate accounts that violate these Terms or pose security or legal risk.
4. Credits, one-time purchases & billing
Certain features consume credits. Credit grants, pricing, and consumption rules are shown in the Service and may change.
Paid credit-pack purchases are processed by Creem as merchant of record and payment processor. Creem may collect payment, tax, billing, and fraud-prevention information at checkout under its own customer terms and privacy notices.
Credit packs are one-time purchases. They do not renew automatically, and purchased credits remain available until consumed. Payment history and receipts are available through the Creem customer portal.
A purchase may be refunded where required by law or when approved by support. If purchased credits remain, a refund or dispute may revoke those remaining credits; credits already consumed may not be recoverable. We may adjust credit balances to correct errors or abuse.
5. Your content
You retain ownership of prompts, uploads, and other content you submit ("User Content").
You grant Tanumo a worldwide, non-exclusive license to host, process, reproduce, and display User Content solely to operate, improve, and secure the Service.
You represent that you have all rights necessary for User Content and that it does not infringe third-party rights or violate law.
6. Acceptable use
You may not use the Service to: violate law; infringe intellectual property or privacy rights; distribute malware; harass others; generate illegal, harmful, sexual, hateful, violent, deceptive, impersonating, or abusive content; generate or facilitate regulated or prohibited goods or services; circumvent safety, moderation, security, or credit limits; or resell the Service without permission.
NSFW, explicit sexual, pornographic, nude, erotic, sexually suggestive, sexual exploitation, deepfake, face-swap, non-consensual intimate imagery, or sexualized images of real people or minors are strictly prohibited.
AI image generation requests may be reviewed by automated or provider-side moderation systems. We may block prompts, remove content, restrict access, or terminate accounts that violate these Terms or create legal, safety, payment, or platform risk.
7. Intellectual property
Tanumo and its licensors own the Service, software, branding, and documentation. No rights are granted except as expressly stated.
Subject to these Terms and applicable law, you may use AI-generated output from the Service for your lawful business purposes. Output may not be unique; similar results may be generated for others.
8. AI output disclaimer
AI-generated assets may contain errors, biases, or unintended similarities to existing works. You are responsible for reviewing output before commercial use.
The Service is not a substitute for professional legal, design, or compliance advice.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of liability
To the maximum extent permitted by law, Tanumo and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
Our total liability for claims arising from the Service will not exceed the greater of (a) amounts you paid us in the twelve months before the claim or (b) USD $100, except where liability cannot be limited by law.
11. Indemnification
You will indemnify and hold harmless Tanumo from claims arising from your User Content, misuse of the Service, or violation of these Terms, to the extent permitted by law.
12. Termination
You may stop using the Service at any time. We may terminate or suspend access for breach of these Terms.
Provisions that by nature should survive (including intellectual property, disclaimers, limitations of liability, and dispute terms) will survive termination.
13. Governing law & disputes
These Terms are governed by the laws applicable in the jurisdiction where Tanumo is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
Disputes should first be raised with us at the contact below. Where permitted, courts in our principal place of business have exclusive jurisdiction.
14. Changes
We may update these Terms. Material changes will be posted with an updated date. Continued use after changes constitutes acceptance where permitted by law.
